Terms and conditions for gift vouchers from the Formion.Art online workshop.
1. Introductory Provisions
1.1 These Terms and Conditions govern the purchase, delivery, and redemption of gift vouchers (hereinafter referred to as the "Voucher") in the online shop https://formion.art (hereinafter referred to as the "Online Workshop"), operated by Metaverse Media s.r.o., with its registered office at Hlavní 180, Tehovec, Czech Republic, Company ID (IČ): 17074126, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File 366216 (hereinafter referred to as the "Seller"), contact: hello@formion.art.
1.2 Matters not expressly regulated by these Terms and Conditions shall be governed by the Online Workshop’s General Terms and Conditions, Complaints Procedure, and Privacy Policy. In the event of any conflict, these Terms and Conditions shall prevail regarding Vouchers.
1.3 The Buyer is the person who purchases the Voucher. The Holder is anyone in possession of or knowledgeable of the Voucher code. The Recipient is the person to whom the Buyer gifts the Voucher.
2. What Is a Voucher
2.1 A Voucher is a voucher redeemable in the Online Workshop to cover the purchase price of goods and services up to its nominal credit value in CZK. The Voucher is neither a security nor an official instrument of payment and cannot be exchanged for cash, except under the circumstances outlined in Article 7.
2.2 The Voucher is issued to bearer: anyone who knows its code can redeem it. Keep the code as secure as cash. The Seller is not responsible for the redemption of a Voucher by an unauthorized individual to whom the Buyer or Recipient disclosed the code, or who obtained it without their consent, unless the loss or unauthorized disclosure was reported to the Seller prior to redemption (Article 8).
2.3 Voucher denominations are displayed on the vouchers page of the Online Workshop (fixed denominations or a custom amount within the offered range).
2.4 The Voucher constitutes a multi-purpose voucher pursuant to Section 24a of Act No. 235/2004 Coll., on Value Added Tax. The Seller is not registered for VAT (not a VAT payer).
3. Ordering, Pricing, and Payment
3.1 Vouchers are ordered via the vouchers page. The Buyer selects the denomination, execution format (electronic PDF voucher, printed voucher, engraved cardboard, engraved specialty paper, or engraved plywood; A5 format), visual design, and personalization texts.
3.2 The total order price consists of the Voucher's face value, the price of the selected execution format, and, for physical formats, shipping charges. All amounts are stated on the vouchers page and in the order summary prior to submission.
3.3 A Voucher cannot be purchased using another Voucher, and promotional discount codes cannot be applied to the purchase of a Voucher.
3.4 The purchase contract is concluded upon confirmation of the order by the Seller in accordance with the General Terms and Conditions. Payment must be made by bank transfer to the Seller’s bank account (payment details and a QR code are provided in the order confirmation). The Voucher is issued only after payment has cleared and been credited to the account.
4. Personalization and Preview
4.1 Personalization text (dedications, names) is provided by the Buyer, who warrants that such text does not infringe on any third-party rights or violate public order/morals. The Seller reserves the right to reject an order containing inappropriate text prior to issuing the Voucher, in which case the paid amount will be refunded.
4.2 For engraved formats, characters not supported by the selected font will be automatically substituted with a similar glyph or a question mark. The Buyer is notified of this directly in the preview before submitting the order.
4.3 The on-screen preview is indicative. While the color and grain of physical materials closely resemble the images, natural variations in material structure and shade may occur.
5. Delivery
5.1 Electronic Voucher (PDF): Once payment is credited, the Seller will email the Buyer a link to the Voucher access page, where the PDF containing the code can be downloaded. For security, the code itself is not included in the email text. The download link remains active for 30 days; a renewed link can be accessed via the user account or requested directly from the Seller.
5.2 If the Buyer provides the Recipient’s email address and designates a delivery date, the Seller will email the access link directly to the Recipient on that day. The Buyer confirms that they are legally authorized to provide the Recipient’s email address to the Seller.
5.3 Physical Vouchers are produced by the Seller after payment clears and dispatched by mail/courier to the address specified by the Buyer, typically within 2 business days of payment receipt.
6. Validity and Redemption
6.1 The Voucher is valid for 12 months from the date payment is credited. The exact expiration date is printed on the Voucher, displayed on the Voucher access page, and accessible in the user account. Upon expiration, any unredeemed credit is forfeited without refund or compensation.
6.2 The Voucher is redeemed by entering its code into the promo code field in the shopping cart prior to completing an order. The credit will be applied toward the total order amount (including shipping costs) after any applicable discounts are calculated. A maximum of 5 Vouchers can be redeemed within a single order; Vouchers may be combined with promotional discount codes.
6.3 Any unused balance remains attached to the Voucher code and can be applied toward subsequent orders until its expiration date. If the Voucher balance is insufficient to cover the total order amount, the customer must pay the remaining balance via bank transfer.
6.4 Entering a Voucher code during checkout temporarily reserves its credit; the deduction is finalized upon completed payment of the order. If an order remains unpaid and is canceled, the reserved credit is automatically returned to the Voucher.
6.5 The remaining balance and validity date can be checked in the cart, on the Voucher access page, or in the user account (provided the account email matches that of the Buyer or Recipient).
7. Right of Withdrawal, Cancellation, and Refunds
7.1 A consumer has the right to withdraw from a purchase contract for an electronic Voucher without giving any reason within 14 days of contract conclusion, provided the Voucher has not been redeemed in whole or in part. The Seller will refund the amount received within 14 days of withdrawal using the original payment method; the Voucher will be voided upon refund.
7.2 Pursuant to Section 1837 of Act No. 89/2012 Coll., the Civil Code, the statutory right of withdrawal does not apply to physical Vouchers custom-made or personalized according to the Buyer’s specifications; the Buyer is explicitly notified of this prior to order submission.
7.3 If an order paid in whole or in part using a Voucher is canceled, the portion paid by Voucher is credited back to that Voucher; this does not extend its original validity period. Amounts paid via other methods are refunded in accordance with the General Terms and Conditions. If the Voucher has expired by the time of cancellation, any credit reinstatement is decided solely at the Seller’s discretion.
7.4 Neither the Voucher nor any unused balance is refundable in cash, except in the case of statutory withdrawal under Article 7.1 or where required by law.
8. Loss, Theft, and Misuse
8.1 Any loss or theft of a Voucher code should be reported immediately to the Seller at hello@formion.art. Following identity verification (using the email address associated with the original order), the Seller will block the compromised Voucher and issue a replacement with the remaining credit and identical expiration date.
8.2 In the event of reasonable suspicion of fraud, abuse, or unauthorized activity, the Seller reserves the right to suspend or block the Voucher; if the Holder’s contact details are known, the Seller will notify them.
9. Defects in Physical Formats
9.1 Rights and obligations regarding defective performance for physical formats are governed by the Complaints Procedure and the Czech Civil Code; the Seller will replace a defective physical Voucher. Natural variations in material color or structure as described in Article 4.3 do not constitute manufacturing defects.
10. Protection of Personal Data
10.1 The Seller processes the personal data of the Buyer and the Recipient (name, email address, custom dedication) for the purposes of issuing, delivering, and recording the redemption of the Voucher (performance of a contract and legitimate interest pursuant to Article 6(1)(b) and (f) of Regulation (EU) 2016/679, GDPR). Dedications and the Recipient’s email address are permanently anonymized no later than 12 months after the Voucher has expired or been fully depleted; records required for statutory accounting purposes are retained for the periods mandated by law. 11. Out-of-Court Settlement of Consumer Disputes
11.1 The authority competent for the out-of-court settlement of consumer disputes arising from contracts concluded hereunder is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, Czech Republic, web: www.coi.cz (pursuant to Section 20d et seq. of Act No. 634/1992 Coll., on Consumer Protection).
12. Final Provisions
12.1 The Seller reserves the right to amend these Terms and Conditions. Each Voucher is governed by the version in force on the date of its purchase; the Buyer consents to this wording during checkout, and the corresponding version is recorded with the order details.
