General Terms and Conditions (GTC)

1. Introductory Provisions

1.1. These General Terms and Conditions (hereinafter referred to as the "GTC") of Metaverse Media s.r.o., Company ID: 17074126, registered office at Hlavní 180, Tehovec, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 366216 (hereinafter referred to as the "Seller"), regulate the mutual rights and obligations arising in connection with or on the basis of a purchase agreement or a contract for work (hereinafter referred to as the "Contract") concluded between the Seller and the buyer (hereinafter referred to as the "Buyer") via the online store at the internet address https://web-test.formion.art.

1.2. The provisions regulating consumer rights do not apply to a Buyer who acts within the scope of their business activity when concluding the Contract (i.e., purchasing with a Company ID).

2. Conclusion of the Contract and Custom Production

2.1. The formion.art e-shop primarily specializes in custom production. Custom production is understood as the delivery of goods that are manufactured, modified, or personalized based on the individual wishes of the Buyer.

2.2. The presentation of goods on the website is for informational purposes only. The Contract is concluded only at the moment when the Seller confirms the receipt of the order and, in the case of custom production, potentially agrees with the Buyer on the final graphic or technical design.

3. Payment Terms and Order Cancellation

3.1. Due to the nature of custom production, the Seller is entitled to request a deposit of up to 100% of the purchase price before commencing physical production.

3.2. The purchase price can be paid in the following ways:

• Bank transfer to the account specified on the invoice.

• Using a QR payment code.

3.3. If the Buyer cancels an order for custom goods during its processing, the Seller is entitled to charge a cancellation fee reflecting the demonstrably incurred costs:

• Cancellation after the design is created, but before physical production: 50% of the price.

• Cancellation after the commencement of physical production and material consumption: 100% of the price.

4. Delivery of Goods and Failure to Accept the Shipment

4.1. The Buyer is obliged to accept the ordered goods. If the Buyer fails to accept the shipment without a valid reason, it constitutes a breach of the Contract, not a withdrawal from the Contract.

4.2. In the event of failure to accept the shipment, the Buyer is obliged to reimburse the Seller for all provable costs associated with shipping and returning the goods in a flat-rate amount of CZK 500. For custom goods, the obligation to pay the full price of the goods remains unaffected.

5. Withdrawal from the Contract (Return of Goods)

5.1. Exception for custom production: The Buyer (consumer) acknowledges that under the provisions of Section 1837(d) of the Civil Code, they cannot withdraw from the Contract within the 14-day period without giving a reason if it concerns the delivery of goods that have been modified according to the consumer's wishes or for their person (formion.art custom production).

5.2. Stock (unmodified) goods: If the Buyer purchases standard stock goods without custom modifications, they have the right to withdraw from the Contract within 14 days of receiving the goods.

5.3. The Buyer can execute the withdrawal online via the "Withdraw from Contract" button available in the order details, which will guide them through a two-step confirmation process.

5.4. The costs of returning the goods to the Seller in the event of a withdrawal are borne by the Buyer. If the Buyer returns the goods damaged or worn beyond normal testing, the Seller is entitled to compensation for the decrease in the value of the goods.

6. Final Provisions

6.1. The Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Prague 2, internet address: https://adr.coi.cz/, is competent for the out-of-court settlement of consumer disputes.
